These Terms of Service ("Terms") govern your use of arcguardsupply.com (the "Site") and any purchase you make from ArcGuard Supply Inc. ("ArcGuard Supply," "we," "us" or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can use the Site

You must be at least 18 years old, or the age of majority where you live, to place an order. If you order on behalf of a business, you confirm that you have authority to bind that business to these Terms.

If you create an account, keep your login details private. You are responsible for activity on your account. Let us know right away if you think someone has used it without permission.

2. Products and safety information

We sell welding safety gear, protective clothing and shop accessories made by third-party manufacturers. Product descriptions, specifications, sizing and safety standard information come from the manufacturer. We work to keep this information accurate, but we do not guarantee that every detail is complete, current or error-free.

Protective equipment reduces risk. It does not eliminate it. You and your employer are responsible for:

• Assessing the hazards of your work and choosing protection that is rated for those hazards
• Following the manufacturer's instructions for use, care, inspection and replacement
• Making sure gear fits properly and is in good condition before each use
• Meeting any workplace safety rules that apply to you, including OSHA requirements

Guides, charts and recommendations on the Site, including our Buyer's Guide, Size Guide and Safety Standards pages, are general information. They are not a substitute for a workplace hazard assessment or professional safety advice.

3. Pricing and availability

All prices are in U.S. dollars. Prices, promotions and product availability can change without notice. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order for that product, even after you receive an order confirmation. If we cancel an order you have paid for, we will refund you in full.

4. Orders and payment

Your order is an offer to buy. We accept your order when we ship it. We may refuse, limit or cancel any order, including orders that appear to be placed by resellers or that we believe may be fraudulent. We may also limit quantities per customer or per order.

You agree to provide current, complete and accurate billing and shipping information, and to pay all charges at the prices in effect when you order, plus shipping and any applicable taxes.

5. Shipping, title and risk of loss

We ship to addresses in the United States. Delivery times are estimates, not guarantees. Title to products and risk of loss pass to you when we deliver them to the carrier. See Shipping & Delivery for rates and timing.

6. Returns and exchanges

Returns and exchanges are handled under our Returns & Exchanges policy, which is part of these Terms. For safety and hygiene reasons, protective equipment that has been worn or used cannot be returned.

7. Warranties

Products may come with a warranty from their manufacturer. Any warranty claim is handled under that manufacturer's terms, and we are happy to help you start one.

Except for any manufacturer warranty and except where the law does not allow it, products and the Site are provided "as is" and "as available." To the fullest extent permitted by law, ArcGuard Supply disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, ArcGuard Supply and its owners, employees, suppliers and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site or any product. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

Some states do not allow certain warranty disclaimers or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits any rights you have that cannot be waived under applicable law.

9. Indemnification

You agree to defend, indemnify and hold harmless ArcGuard Supply and its owners, employees, suppliers and partners from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of any product or your violation of any law or the rights of a third party.

10. Acceptable use

You agree not to use the Site to break the law, infringe anyone's rights, upload malicious code, interfere with the Site's security or operation, scrape or collect data without our permission, or submit false or misleading information. We may suspend or end your access to the Site if you violate these Terms.

11. Content and intellectual property

The Site and its content, including text, graphics, logos, photos and page designs, belong to ArcGuard Supply or its licensors and are protected by intellectual property laws. Product names, brands and images belong to their respective owners. You may not copy, reproduce or reuse Site content for commercial purposes without our written permission.

If you send us comments, reviews, ideas or other submissions, you give us permission to use them without restriction or payment. You are responsible for making sure your submissions are accurate and lawful.

12. Third-party links and services

The Site may link to or use services from third parties, such as payment processors and shipping carriers. We are not responsible for third-party websites or services, and your use of them is subject to their own terms.

13. Privacy

Our Privacy Policy explains how we collect and use your personal information.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. Changes take effect when we post them on this page. Your continued use of the Site after a change means you accept the updated Terms.

16. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with the policies they reference, are the entire agreement between you and ArcGuard Supply about the Site and your purchases.
